Motionaly, LLC (“Motionaly,” “we,” “us,” or “our”) operates the Motionaly platform (collectively, the “Service”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you access or use the Service.

  • Payment Information: If you purchase a subscription, our payment processor (LemonSqueezy and/or Stripe) collects payment information. We do not store full credit card numbers on our servers.
  • User Content: Text prompts, uploaded images, audio files, and other materials you submit to the Service (“User Content”).
  • Communications: Records of correspondence when you contact us (e.g., support requests, feedback).
  • Profile Information: Any additional information you provide, such as a profile picture or company name.

1.2 Information Collected Automatically

  • Usage Data: Information about how you interact with the Service, including: features used, generation history, project names, and session duration.
  • Device Information: Browser type, operating system, device identifiers, and device capabilities.
  • Log Data: IP addresses, access times, pages viewed, and referring URLs.

1.3 Information from Third Parties

  • AI Model Providers: When you use AI generation features, certain metadata (e.g., token usage, model version) may be transmitted to our AI model providers (MiniMax, Moonshot AI, OpenAI, Anthropic) as required for providing the Service.
  • Authentication Providers: If you sign in via third-party services (e.g., Google, GitHub), we receive basic profile information from those providers.
  • Analytics Providers: We use PostHog and similar analytics services that collect data about your usage of the Service.

2. How We Use Your Information

We use your information for the following purposes:

  • Providing the Service: To generate animations, process payments, manage your account, and deliver the features of the Service.
  • Improving and Developing: To understand how users use the Service, identify bugs, and improve our products and features.
  • Communication: To send you service-related notices, updates, security alerts, and support responses.
  • Analytics: To analyze usage patterns and trends using PostHog and similar tools to improve user experience.
  • Security: To detect, prevent, and respond to fraud, security threats, and prohibited activities.

  • AI Processing: To transmit your prompts and content to AI model providers for the purpose of generating animations as part of the Service.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

3.1 AI Model Providers

Your prompts and User Content are transmitted to AI model providers (MiniMax, Moonshot AI, OpenAI, Anthropic) to generate animations. Each provider processes this data under their own privacy policies and terms of service. We encourage you to review their policies:

3.2 Service Providers

We share information with trusted service providers who assist us in operating the Service:

  • Cloud Infrastructure: Vercel, AWS, or similar providers for hosting and infrastructure.
  • Payment Processing: LemonSqueezy and Stripe for subscription billing. Their privacy policies govern their use of your data.
  • Analytics: PostHog for product analytics.
  • Email Delivery: Email service providers for transactional and marketing emails.
  • Database: Supabase for authentication, data storage, and edge functions.

3.3 Legal Requirements

We may disclose your information if required by law, regulation, legal process, or governmental request, including:

  • To comply with a subpoena, court order, or similar legal process
  • To enforce our Terms of Service or Acceptable Use Policy
  • To protect the rights, property, or safety of Motionaly, our users, or the public
  • To respond to claims that content violates third-party rights

3.4 Business Transfers

If Motionaly is involved in a merger, acquisition, asset sale, or bankruptcy proceeding, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on the Service before your information is transferred and becomes subject to a different Privacy Policy.

4. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service. Specifically:

  • Account Data: Retained until you delete your account or for 30 days after account deletion for operational purposes.
  • Generated Content: Animations and projects you create are stored until you delete them or your account is deleted.
  • Usage Data: Retained for a maximum of 24 months for analytics and product improvement purposes.
  • Payment Data: Retained in accordance with applicable tax and accounting requirements (typically 7 years).

Even after account deletion, some information may be retained if required by law or for legitimate business purposes, such as resolving disputes or enforcing our agreements.

5. Cookies and Tracking Technologies

5.1 What We Use

  • Essential Cookies: Required for the Service to function. They enable authentication, session management, and security features. These cannot be disabled without degrading the Service.
  • Analytics Cookies: Used by PostHog and similar tools to understand how you use the Service. We use PostHog’s self-hosted or cloud deployment depending on configuration.
  • Marketing Cookies: We generally do not use third-party marketing cookies. If we introduce them in the future, we will update this policy and obtain consent as required.

5.2 Managing Cookies

5.3 Do Not Track

We do not currently respond to Do Not Track signals from web browsers, as there is no industry-standard mechanism for honoring such signals.

We implement appropriate technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include:

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

8. Children's Privacy

The Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information as soon as possible. 9. International Data Transfers

Motionaly is based in the United States. Your information may be transferred to and processed in the United States and other countries where we or our service providers operate. These countries may have different data protection laws than your country of residence.

When we transfer personal information outside of your jurisdiction, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses (SCCs) or equivalent mechanisms, where required by applicable law.

10. AI-Specific Disclosures

10.1 How AI Models Use Your Data

When you submit a prompt to generate an animation, your prompt and any associated content are transmitted to our AI model providers. This data is used solely to generate the requested animation. We do not use your prompts or generated content to train AI models unless you have provided explicit consent for such use.

10.2 Model Provider Data Practices

Each AI model provider (MiniMax, Moonshot AI, OpenAI, Anthropic) processes your prompts under their own privacy policies. We encourage you to review their policies to understand how they handle your data.

10.3 Prohibited Data

You must not submit personal information of third parties to the Service without their consent, or sensitive data (health data, financial data, government IDs) that you are not authorized to share. We are not responsible for any personal information you choose to include in your prompts.

11. Changes to This Policy

We may update this Privacy Policy at any time. If we make material changes, we will:

  • Post the updated policy on this page and update the “Last updated” date
  • Send an email notification to the address associated with your account (for material changes)
  • Display a prominent notice on the Service

Your continued use of the Service after any changes constitutes your acceptance of the updated Privacy Policy.
